Felony vs. Misdemeanor
In Illinois, there are two types of criminal charges - Felony and Misdemeanor. Illinois Felony criminal charges are punishable by a year or more in prison, depending on the class of felony. Misdemeanor criminal charges are punishable by less than one year in jail, again depending on the misdemeanor class. Whether charged with an Illinois felony or misdemeanor criminal case, sentences are often available which do not involve imprisonment. Every criminal defendant is entitled to trial by judge or jury.

Public Defenders
If a defendant cannot afford to hire a lawyer, the court may appoint a public defender to represent the defendant. In many cases, judges will not appoint a public defender unless the State is seeking jail time. It should be noted that public defenders typically represent hundreds of defendants at one time. This often prevents them from devoting significant attention to each client they represent.
